About Product Liability Claims

Under the Consumer Protection Act 1987, manufacturers, importers, and in some cases suppliers are strictly liable for damage caused by defective products. This means the claimant does not need to prove negligence — only that the product was defective and caused their injury.

A product is considered defective if its safety is not such as persons generally are entitled to expect. Three types of defect are recognised: design defects (the product's design is inherently unsafe), manufacturing defects (a specific unit was made incorrectly), and failure to warn (inadequate instructions or safety warnings).

These cases cover an enormous range of products: vehicles and vehicle parts, pharmaceuticals and medical devices, consumer electronics, power tools, children's toys, and food products. Group litigation orders (GLOs) allow multiple claimants to pursue claims together, similar to class actions.

Individual product liability claims commonly settle for £10,000 to £500,000. Mass claims can reach enormous totals — the PIP breast implant scandal affected thousands of UK women, and the Volkswagen dieselgate settlement provided compensation to affected UK car owners. The limitation period is 3 years from injury or knowledge, with a 10-year longstop date from when the product was supplied.
