Passenger claims arise when a vehicle passenger is injured in a road traffic accident. Passengers are in a strong position because they are almost never at fault for the accident — they can claim against the driver of the vehicle they were in, the other driver, or both.

If the driver of your vehicle was at fault, you claim against their motor insurer. If another driver was at fault, you claim against that driver's insurer. If both drivers share responsibility, both insurers contribute. The passenger's claim is not affected by any contributory negligence between the drivers.

Contributory negligence may reduce a passenger's award if they were not wearing a seatbelt (typically a 15-25% reduction), knew the driver was drunk, or encouraged dangerous driving. However, simply being a passenger in a vehicle does not create any contributory negligence.
