Industrial Disease

Industrial disease claims arise when workers develop illnesses caused by exposure to hazardous substances or conditions in the workplace over an extended period. These claims differ from accident claims because the disease develops gradually, often years or decades after exposure.

Common industrial diseases include mesothelioma and asbestosis (from asbestos exposure), noise-induced hearing loss (industrial deafness), hand-arm vibration syndrome (HAVS) from vibrating tools, occupational asthma from workplace chemicals, silicosis from stone dust, and occupational dermatitis.

For asbestos diseases, the employer often no longer exists. The Diffuse Mesothelioma Payment Scheme provides compensation when an employer and their insurer cannot be traced. The Compensation Act 2006 and Mesothelioma Act 2014 assist claimants. For noise claims, evidence of exposure levels and failure to provide hearing protection is key.

The limitation period runs from the "date of knowledge" — when the claimant first knew (or should have known) that their condition was caused by workplace exposure. This means claims can be brought decades after the exposure occurred.

Compensation for industrial deafness typically ranges from £5,000 to £30,000. HAVS claims settle for £5,000 to £25,000. Mesothelioma claims typically settle for £100,000 to £350,000. Asbestosis and other progressive conditions can reach £50,000 to £200,000. The limitation period is 3 years from the date of knowledge.
